Jurors Deliberate Fate of DePuy Pinnacle Hip Trial in Dallas
Attorneys made their closing arguments today in the DePuy Pinnacle Metal on Metal hip replacement trial. Now the case is in the hands of the jury, which also began deliberations today, March 10, 2016.
Proceedings began weeks ago and jurors spent a total of 37 days in court listening to testimony and reviewing evidence. Jury selection took place on January 8, 2016. Nine jurors were chosen and seated for the trial, according to the electronic minutes listed on the US District Court, Northern District of Texas website for MDL 3:11-md-02244.
After opening statements defense attorneys for DePuy moved for a mistrial, saying the plaintiffs tried to “prejudice the jury against defendants by introducing irrelevant, highly inflammatory evidence that has no place in a product liability trial,” according to Harris Martin Publishing. Federal Judge Ed Kinkeade denied the motion for mistrial and rejected the claim that the statements were “highly inflammatory.”
The first witness called by the Plaintiffs in January was Andrew Ekdahl, former CEO of DePuy Orthopaedics. Also on the witness stand, Pam Plouhar, head of Clinical Research at DePuy, Dr. Antoni Nargol testified by video deposition, and a number of other surgeons and orthopedic experts took the stand.
