mctlaw Secures $55,000 Vaccine Injury Award for Client with Shoulder Injury
An mctlaw client was awarded $55,000 in compensation from the Vaccine Injury Compensation Program after suffering a shoulder injury (SIRVA) from a flu shot (Case No. 22-724). The ruling, issued by the Court of Federal Claims on February 6, 2025, marks a significant victory for the client and highlights the critical role of experienced legal representation in vaccine injury cases.
The client, a New Hampshire resident, received a routine flu shot in 2021. Before the vaccination, she was in excellent health and led an active lifestyle. However, shortly after getting the injection, she developed pain in her arm. Within days, her mobility was severely limited—she could no longer lift or extend her arm without extreme discomfort.
The client turned to mctlaw’s vaccine injury legal team for help. Attorney Catherine Costigan skillfully presented her case before the Vaccine Court. Costigan argued that the client suffered from SIRVA, or shoulder injury resulting from vaccine administration, a recognized vaccine-related injury. Following litigation, the Court ruled in the client’s favor, allowing for a $55,000 settlement to move forward.

“This case faced the typical opposition that we see from the government on SIRVA claims,” said Costigan. “With some litigation and persuasive argument, we were happy to bring this claim to a successful conclusion for a very deserving client.”

SIRVA can happen when a vaccine is injected improperly, often too high in the shoulder or too deep. It can be very painful, and may lead to other complications, like adhesive capsulitis or frozen shoulder syndrome. Symptoms and complications may include:
- Frozen shoulder or adhesive capsulitis
- Shoulder tendonitis
- Rotator cuff tear
- Shoulder bursitis
- Impingement syndrome
