Those injured by COVID vaccine adverse reactions deserve compensation!

For most vaccinations administered in the United States, real compensation for adverse reactions is available. In the 1980s, Congress and the Reagan Administration created a compensation system for vaccine adverse reactions. Claims for compensation are brought in the United States Court of Federal Claims, a federal court in Washington, D.C. Over 5 billion dollars in compensation has been paid out by the Vaccine Injury Compensation Program (VICP) to those injured by serious adverse reactions.

Unfortunately, those injured by COVID vaccine injury adverse reactions are not able to seek compensation in the VICP. Instead, COVID vaccine injury claims can only be brought in the Countermeasures Injury Compensation Program (CICP). The CICP was never meant to handle a widely administered vaccine like the COVID vaccine. As a result, the CICP has completely failed to help those with severe adverse reactions to COVID vaccinations.

The CICP does not help people with serious COVID vaccine adverse reactions.

Often described as a legal “black hole,” the CICP is ineffective and lacks accountability.

As of December 1, 2024, 13,555 people in the United States had filed compensation claims in the CICP for severe injuries caused by the COVID vaccine. As of December 1, of the 13,555 people filing COVID vaccine injury claims with the CICP, only 20 have been awarded compensation. Except for compensation in one death case, the average compensation to these people for their severe injuries, medical expenses, lost wages, and other damages is approximately four thousand dollars each.

The CICP lacks the basic protections of the legal system. There is no transparency, no court, no judge, no right of appeal to a higher court. A nameless Health and Human Services (HHS) administrator reviews claims and decides compensation with no public oversight. People who file claims in the CICP cannot challenge the decisions made by the administrators. The decision of the unaccountable bureaucrat is final.

The VICP would provide real compensation for those that suffered severe COVID vaccine adverse reactions.

People that suffered severe adverse reactions to a COVID vaccination should be able to obtain compensation from the Vaccine Injury Compensation Program (VICP). Unlike the CICP, the almost four decade old VICP:

  • Has paid out more than $5.2 billion to almost ten thousand vaccine injured people in the United States.
  • Claims are decided by the U.S. Court of Federal Claims.
  • The VICP has approximately $4.5 billion in trust to pay awards.
  • Awards cover pain, suffering, lost wages, and past and future medical expenses.
  • You can hire an attorney to handle your claim in the VICP and pay no legal fees. Instead, fees are awarded by the Court.

The VICP should already provide compensation for injuries from severe COVID vaccine adverse reactions.

A lawsuit has been filed by mctlaw due to the failure of the Secretary of Health and Human Services to meet the deadline required by federal law to include the COVID vaccine in the VICP. The lawsuit was filed by mctlaw in the Federal District Court for the District of Columbia. The lawsuit alleges HHS failed to amend the Vaccine Injury Table as required by federal law within two years of the Centers for Disease Control (CDC) recommending the COVID vaccine for routine administration to those age 18 and below. If the Secretary adds the COVID vaccine to the Vaccine Injury Table, Congress will then need to authorize a payment of 75 cents from vaccine manufacturers to the VICP for each future COVID vaccine dose sold. As soon as Congress authorizes the 75-cent payment, injured people will be eligible to seek compensation from the Vaccine Injury Compensation Program.

What can I do to help myself?

File a VAERS report about your COVID vaccine injury.

File a patient report in the Vaccine Adverse Even Reporting System (VAERS) and save a copy of it. VAERS is a nations early warning reporting system used to detect safety problems in U.S. licensed vaccines.

Sign the petition asking the federal government to include COVID vaccine injuries in the VICP.

Sign the Change.org petition asking the Secretary of Health and Human Services to add the COVID-19 vaccine to the Vaccine Injury Compensation Program.
